Conditions of Use

This is a contract with Trauma Analytics, LLC, a Texas limited liability corporation here forward referred to as "Trauma Analytics" or "TA". Please read the following conditions of use before accessing this site, completing the online registration process, or logging into www.traumaanalytics.com. By accessing the TA site(s), app(s), or service(s) (including but not limited to: visiting, registering, purchasing, or accessing a course) you agree and accept all of the conditions, terms, and policies imposed within this agreement. If you do not agree to the following conditions, terms, and policies then you may not access the site(s), app(s), or service(s). By accessing and using TA services, you agree that you have read, understand, and agree to the following conditions, terms, and policies. You also agree to review this agreement when access TA resources to be aware of modifications to the contract agreement. TA may make modifications at any time without notification. Your continued use of TA site(s), app(s), or service(s) will be understood and deemed your conclusive acceptance of any modified agreement.


1) General Conditions, Terms, and Policies

1.A) TA reserves the right to change the content contained within a course or on the site(s) at any time without any advanced notice. 1.B) Students who fail to complete online e-learning course(s) in the scheduled / available time will not be eligible for a refund of the course fee(s). 1.C) Student(s) who take courses which require access to AHIMA virtual laboratory will be provided access code by TA, no refund will be provided to courses when an associated AHIMA virtual laboratory access code is provided, students must agree and follow TA Terms and Policies along with AHIMA outlined virtual laboratory terms and policies. 1.D) Students will receive an electronic notification to the email address on file at time of registration prior to the course end date. 1.E) Trauma Analytics reserves all rights not expressly granted herein. 1.F) These conditions, terms, and policies shall be governed in accordance with the laws of the State of Texas. 1.G) Trauma Analytics is committed to protecting your privacy and outlines all privacy information within the privacy section of this agreement. 1.H) TA quotes, prices, and invoices are issued in United States dollars (USD) all payments must be made in USD. 1.I) Students must pay in full or enter a course access key before starting education courses offered by TA. 1.J) All formats and layouts contained on TA site(s) and app(s) is property of TA and it is prohibited to make copies, distribute, or changing without written permission issued by TA. 1.K) All students understand TA may record training and education courses and by accessing this site you consent to video/audio recording of any and all sessions. The excerpts from these recordings, or descriptions of them may be used by TA staff for the purposes of supervision, research, and teaching. Students understand TA will not edit recordings thus personal identifying information can be used by TA. Students understand that any recordings will be for professional purposes only and in the interest of improving professional standards or continued training for fellow students and TA staff. All students and instructors consent to being recorded and these recording being used by TA or TA partnering organizations.


2) Privacy Policy

2.A) TA is committed to protecting your privacy. This privacy policy outlines and describes our practices regarding the personal information that maybe collected from users of our site(s), app(s), or service(s). When submitting personal information through TA site(s), app(s), or service(s), you expressly consent to the processing of your personal information in the United States in accordance with this Privacy Policy. 2.B) TA will collect data and information from you, such as first name, last name, gender, email, mailing address, professional title, professional license, professional title, company / hospital name, and password when you create an account to login to our network of solutions and services. TA also may retain information on your behalf, such as files, messages, photos, and course content you store using your TA account. If you provide TA with feedback, information, or contact us via email, we will collect your name and email address, as well as any other content included in the email. When you complete a course or survey, we reserve the right to collect and use additional information including but not limited to profile information. TA also collects other types of personal information and demographic information that you provide voluntarily to us when using our site(s), app(s), or service(s). 2.C) To make our site(s), app(s), and server(s) more useful to you, our servers (which may be hosted by a third party service provider) collect information about your browser type, operating system, internet protocol (IP) address, domain name, unique device identifies, and information about how you use TA site(s), app(s), or service(s) and include date and time of your visit. TA will use cookies and web beacons along with navigational data including uniform resource locators (URL) to gather information regarding the date and time of your visit and the solutions and/or courses information for which you accessed, searched, or viewed. Like most internet services, we automatically gather data and store data in log files each time our site(s) are visited, app(s) accessed or used or you access our solutions on our network. We reserve the right to link this automatic collected data to personal identifiable information for use by TA. 2.D) Analytics services are used to help analyze how users use our site(s), app(s), and service(s). Analytics use cookies and scripts to collect and store information including how you interact with our site(s), app(s), and service(s). Error analytics, errors users encounter when using our site(s), app(s), service(s) is collected. Also user access visits, what pages visited, and what other sites they used prior to coming to our site(s). We use the information we get from Google Analytics only to improve our site(s), app(s), and/or service(s). Please visit Google Analytics for more information about the services we use offered by Google Analytics www.google.com/privacy_ads.html, www.google.com/privacy.html, and www.google.com/analytics/tos.html. 2.E) Our site(s), app(s), and service(s) offer public forums for approved registered users to provide information. Information provided within these areas maybe, read, collected, and used by others who access TA site(s), app(s), and service(s). 2.F) TA affiliates, parent company, subsidiaries, joint ventures, or other companies under the common control or contractual partners with TA (collectively, "AFFILIATES"). TA may share some or all of your information with Affiliates, in which case all TA Affiliates are required to honor the Privacy Policy section of TA Terms and Policies. 2.G) TA may share your personal information with third party service providers for the sole purpose of providing you with the Services offered though our site(s), app(s), and service(s). TA is authorized by you to share data with service providers who host our site(s), app(s), and service(s) or provide email services on behalf of TA. 2.H) TA may disclose information about you if TA believes such disclosure is necessary to (a) comply with laws or to respond to lawful request and legal process; or (b) protect or defend the rights, safety, or property of Trauma Analytics, users of services, or any person including to enforce our agreements, policies, terms, and conditions of use, or (c) in an emergency to protect the personal safety of any person. 2.I) TA may also share information about you in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction or proceeding involving sale, transfer, divestiture or disclosure of all or a portion of our business or assets to another company. In these circumstances, we will only share information with a company that has agreed to data privacy standards no less stringent than TA own data privacy standards. In the event that information is shared in this manner, notice will be posted within our terms and policies page on www.traumaanalytics.com. 2.J) TA may share de-identified and aggregated data with others for their own uses. 2.K) TA may allow you to connect and share information with certain social networking platforms (e.g. Facebook, Twitter, LinkedIn). By accessing our site(s), app(s), and service(s) you allow TA to share information with social networking platforms. TA does not control the privacy practices of the social networking platforms and sign-in services you choose to use and this privacy policy does not cover social networking platforms practices, users should visit the privacy policies of each social networking platform or sign-in services you choose to use to understand their practices. 2.L) TA does not offer choices regarding the collection, use, and sharing of your personal information. Most web browsers are set to accept cookies by default, if you prefer, you can typically remove and reject cookies from our site(s), app(s), and service(s) with your browser settings. Should you remove or reject TA cookies, it will impact and affect how our site(s), app(s), and service(s) work for you and we are not responsible for refunding fees for services if cookies have been removed or reject thus preventing proper function of site(s), app(s), or service(s) provided over the web. 2.M) TA allows all users to change some of your personal information in your account by editing your profile. You may request changes or deletions by e-mailing TA at privacy@traumaanalytics.com. TA will respond to your request, when permitted by law, within 30 days. TA will retain your information for as long as your account is active or as needed to provide your services. Some courses which provide nursing and other professional continuing education require documents and personal information to be retained on file for a specified period of years as listed within the regulatory requirements of each licensing agency. TA will retain and use your information as necessary to comply with our regulatory and legal obligations, resolve disputes, and enforce our agreements. We may be unable to delete information that resides in our archives and educational data base. 2.N) Trauma Analytics takes reasonable steps to help protect your personal information in an effort to prevent unauthorized access, use, or disclosure. Despite these measures, you should know that Trauma Analytics cannot fully eliminate security risks associated with personal information. No method of transmission over the internet, or method of electronic storage is 100% secure. Therefore, we cannot guarantee absolute security of your personal information. Any content you post while using TA site(s), app(s), or service(s) is at your own risk. 2.O) Trauma Analytics welcomes your comments or questions regarding our Privacy Policy section of our terms, policies, and conditions of use agreement. 3) Course(s) Payment Policy

3.A) All payments for course(s) must be paid in United States dollars (USD) to either TA, partnering corporation, or course hosting organization. Course payments for partnering corporation(s) and course hosting organization(s) maybe made directly to these organizations. 3.B) If a course has a price listed on the TA website with payment options enabled then these courses must be paid directly to TA. 3.C) If a course has a price listed on the TA website or TA course registration form with the access key option available then the course registration fees should be paid directly to the partnering corporation(s) or hosting organization(s) as listed on the course registration form. In this case each partnering corporation(s) or hosting organization(s) will provide on the registration form payment method(s), pay to information, and registration payment and mailing information to send registration form. 4.D) All payments for course registrations made to partnering corporation(s) or host organization(s) must be paid as arranged and agreed upon by the third party and student registrant for the course. 4.E) All courses which require the AHIMA Virtual Lab "VLab" platform VLab fee is non-refundable.


4) Cancellation Policy

4.A) All cancellations must be received in writing. 4.B) If you cannot access TA course content online via www.traumaanalytics.com due to failing to meet the required system requirements given on the website or within course registration, then TA will not take responsibility and no refund will be provided to the purchaser. 4.C) The partnering corporation(s) or host organization(s) reserves the right to cancel a course up to two weeks prior to the date of the course. In the case of course cancellation by partnering corporation(s) or host organization(s) a full refund of the course fee will be issued by the partnering corporation(s) or host organization(s), the course lab fee if applicable is non-refundable. Trauma Analytics is not responsible for refunding course fees when course payments are made directly to the partnering corporation(s), host organization(s), or third party. 4.D) Should courses be cancelled TA, partnering corporation(s), host organization(s), or third party will not be responsible for any other expenses incurred by the registrant. 4.E) Should a course be cancelled due to an Act of God, by the partnering corporation(s), host organization(s) or third party the right to reschedule the course is reserved or provide refund if requested with five calendar days of cancellation. 4.F) Should student/registrant wish to cancel their participation in a course they should contact TA, partnering corporation(s), host organization(s), or third party in writing to request a refund at which time the refund request will be considered for approval or denial. No refunds are guarantee. 4.G) Request for cancellations less than two weeks prior to the course date will not qualify for a refund. 4.H) TA, partnering corporation(s), host organization(s), or third party are not liable or responsible for other personal expenses incurred by the student or registrant due to cancellation.


5) Learning Materials

5.A) TA reserves the right to change the content used at any time. 5.B) All training material is property of Trauma Analytics or TA partnering organizations. 5.C) All training material has been prepared, maintained, updated, and distributed by TA with the exception of partnering organizations. If a partnering organizations material is used the partnering organization is responsible for preparing, maintaining, updating, and distributing. 5.D) The use of the training material on our courses and partnering organization courses is restricted for use by the registered user who has been supplied with the log in details by TA or partnering organization as part of an authorized course. 5.E) The registered user shall not permit anyone else to copy, use, modify, transmit, distribute, or in any way, exploit the copyrighted materials. 5.F) The materials made available by TA are provided "as-is" without warranties of any kind, either expressed, or implied, including but not limited to , all implied warranties of merchantability, fitness for a particular purpose, title or non-infringement. 5.G) TA does not warrant that the materials will be error free including technical inaccuracies, nor free of viruses, or other harmful matter. The entire cost of any necessary service, repair, or correction is the registered user's responsibility. 5.H) TA may make improvements, or changes, to this material at any time without prior notification. 5.I) All trademarks, service marks, and trade names in this material are the marks of the respective owners and any unauthorized use is prohibited. 5.J) All rights not expressly granted herein are reserved by TA.


6) Access to courses

6.A) Trauma Analytics strives to provide course content to it students on a continuous bases. To that end, TA will take all reasonable efforts to provided uninterrupted access to courses to authorized students. However, from time to time, students may be unable to access the courses due to conditions beyond TA control. Such conditions include, but are not limited to: acts of God, power outages, acts of computer hackers, and others acting outside the law. Also, from time to time, access may be unavailable due to software issues, server downtime, increased internet traffic or downtime, programming errors, regular maintenance of the system, and other related reasons. In response to any unavailability of the courses to its students, TA will take all commercially reasonable steps to ensure access is restored within a reasonable period of time. The term "commercially reasonable," used in these terms and conditions shall mean a reasonable effort taken in good faith without an unduly or burdensome use or expenditure of time, resources, personnel, or money. 6.B) TA strives to provide the highest quality content to it students. To that end, TA reserves the right, in its sole discretion, to change, modify, or discontinue any aspect or feature of this site in whole or in part, including, without limitation, the content, availability, access and/or the terms of this site. Such changes, modification, additions or deletions will be effective immediately upon notice thereof, which notice may be made by posting such changes on this site. 6.C) Users are solely responsible for ensuring they have sufficient and compatible, software, telecommunications equipment and internet service necessary for use of the site. Specific firewalls have been known to cause issues with course content it is the students responsibility to ensure firewalls are not blocking TA course information and/or documents.


7) Third Party Content and Hyperlinks

7.A) TA makes no warranty, either expressed or implied, of the accuracy, merchantability, fitness for a particular purpose, or non-infringement of the information provided by third parties. This includes, but is not limited to, any information found on a link located on this site that allows users to access information found on another site. Additionally, TA does not warrant the existence or functionality of any website which can be accessed through a link located on this site or within a course. 7.B) Copyrights, Trademarks, and other Proprietary rights. 7.C) TA or its third party content providers shall retain all worldwide rights in the intellectual property in and on our site(s), app(s), or service(s) including, but not limited to, trademarks, service marks, trade dress, inventions, ideas, trade secrets, the source code, the HTML code, the look, feel, and layout of our site(s), app(s), and service(s) including color combinations, layout, and all other graphical elements, and the copyrights in and to its original content. You should assume that everything you read or see on the site is copyrighted, trademarked, or otherwise protected and owned or licensed by Trauma Analytics or partners. 7.D) Except as expressly stated on our site(s), app(s), service(s) or in these terms, policies, and conditions nothing that you will read or see on the site or in the courses may be copied, reproduced, modified, distributed, transmitted, republished, displayed or performed for commercial use without the prior written consent of TA, except as provided in these terms, policies, and conditions. Nothing in these terms, policies, and conditions grants you an expressed or implied license to use any of Trauma Analytics intellectual property.


8) Disclaimers and Limitation of Liability

8.A) Users access this site at his/her own risk and provide all information at users own risk. The site is provided on an "as is, as available" basis without warranty of any kind, expressed, implied or statutory, and any and all warranties of merchantability, fitness for particular purpose or non-infringement of third parties' rights are specifically disclaimed. TA does not warrant any particular result from use of the TA software, site(s), app(s), or service(s). TA does not warrant that the information on the site is accurate, complete or complies with any particular regulatory requirement, regulation, or law, or that the operation of an your access to the site will be uninterrupted, error-free, virus-free or completely secure. 8.B) Under no circumstances and under no legal theory (tort, contract, or otherwise) shall TA or any of its affiliates, agents, employees, shareholders, members, officers, third party content providers, successors or assigns be liable to you or any other person or entity for any indirect, special, incidental, punitive, or consequential damages of any kind, including without limitation, damages for loss of goodwill, work stoppage, computer failure, or malfunction, loss of data , loss of productivity or contract, or any and all other commercial damages or losses. 8.C) The use of TA site(s), app(s) or service(s) are at your sole risk and any content that you download is downloaded at your own discretion and risk, and you are solely responsible for any damage to your computer system in excess of the amount TA received from students for a course, and for any loss of data that results from the downloading of any such content, including any damages resulting from computer viruses. 8.D) In no event will TA be liable for any damages in excess of the amount TA received from the student for access to a course, even if TA have been informed of the possibility of such damages, or for any claim by any other party. 8.E) In no event will warranties provided by law, if any, apply unless they are required to apply by statute notwithstanding their exclusion by contract. 8.F) This disclaimer is applicable to any damage or injury resulting from the negligence of an omission of TA computer virus, or other similar item, telecommunications errors, or unauthorized access to or use of user information through theft or any other means. TA is not liable for criminal, tortious, or negligent actions or third parties that affect this site.
